Notice of Public Hearing and Environmental Determination

 

Hearing Date and Location: May 7, 2008 beginning at 7:00 p.m., Chewelah City Council Chambers, City Hall, 301 East Clay Avenue, Chewelah, WA 99109.

 

Review Authority: The Chewelah City Council will hold a public hearing and take action on this proposal.

 

Application/Description of Proposal:  A proposal, file CPA-01-03/REZ-01-03, to amend the comprehensive plan land use designation from Single Family Residential to Commercial for approximately 4.9 acres, and amend the zoning map from Single Family Residential (R-1) to Retail Business (RB) as implementing zone to the Commercial designation.  The total area of the area designated Commercial and zoned Retail Business (RB) is approximately 11 acres.

 

Location of Proposal: Parcel No. 284717 and 284718, located between Meadow Creek Subdivision and US-395, and further located Section 11, Township 32 North, Range 40 East, Willamette Meridian, City of Chewelah, Stevens County, Washington

Environmental Determination:  The City has determined that this proposal does not have significantly adverse environmental impacts, an Environmental Impact Statement (EIS) is not required under RCW 43.21C.030(2)(c).  The City of Chewelah, as lead agency, issues a determination of non-significance (DNS) pursuant to WAC-197-11-340(2).  The lead agency will not act on this proposal for fourteen (14) calendar days from the date issued.  The City must receive comments on this threshold determination no later than 5:00 p.m., May 1, 2008.  This decision was made after review of a completed environmental checklist and other information on file with the lead agency.  This information is available to the public on request.

 

Any appeal of this determination must be submitted to the City within fourteen (14) calendar days after the date issued.  This appeal must be written and make specific factual objections to the City’s threshold determination.  Appeals shall be conducted in conformance with Section 16.04.240 (Appeals) of the City’s Environmental Ordinance; appeals shall be limited to a review of a final threshold determination.

 

Approval Criteria:  City of Chewelah Comprehensive Plan, Chewelah Municipal Code Sections: 18.08.120 (Retail business), 18.16.050 (Amendments), and 16.04 (State Environmental Policy Act Guidelines) are the primary development regulations applicable to the site.

 

Hearing Process and Appeals:  The Chewelah City Council will conduct at least one hearing pursuant to the rules of procedure adopted in the Chewelah Municipal Code. All interested persons may testify at the public hearing and submit written comments before or at the hearing. The City Council may limit the time given to speakers to allow an opportunity for all to participate. In accordance with Section 18.20.030 of the CMC, the City Council shall conduct a public hearing for the purpose of taking testimony, hearing evidence, considering the facts pertinent to the proposal, and evaluating the proposal for consistency with the requirements of this title and other applicable plans and regulations prior to making its decision.  All hearings will be conducted in facilities that are accessible to persons with physical disabilities.

 

Staff Report and Inspection of File:  A staff report will be available for inspection seven (7) calendar days before the hearing. The staff report and application file may be inspected at the Chewelah City Hall, located at the 301 East Clay Avenue, between 8:00 am and 5:00 pm, Monday-Friday, excluding holidays.
